Informed Consent, Waiver, and Release Agreement

This waiver and release is entered into between the participant and Desert Tree Fitness, LLC. DBA Maricopa Adventure Boot Camp / Cristy Curtis, its instructors, officers, affiliates, and executors.

The purpose of the Fitness Program offered by Desert Tree Fitness, LLC. DBA Maricopa Adventure Boot Camp is to provide fitness instruction and coaching for various levels of athletes/individuals.

The participant hereby acknowledge that the following was explained to me and/or agree to the following: 

  1. Acknowledges that Desert Tree Fitness, LLC. DBA Maricopa Adventure Boot Camp, its staff, instructors or trainers are not physicians and are not trained in any way to provide medical diagnosis or any other type of medical advice.
  2. Acknowledges that coaching/training is another tool for teaching athletes/individuals about themselves, but Desert Tree Fitness, LLC. DBA Maricopa Adventure Boot Camp does not guarantee neither good nor bad will occur, nor guarantees the training advice given by Desert Tree Fitness, LLC. DBA Maricopa Adventure Boot Camp and or its instructors will produce good nor bad results.
  3. Acknowledges that the participant has been told if they feel tired, feel pain or feel out of the ordinary in any way either related to your training, or otherwise, that the participant should contact a physician at once.
  4. Acknowledges that boot camps, aerobic classes, martial arts, kick boxing, running, kung-fu, weight training, obstacle courses, and any other related sports are an extreme test of one's mental and physical limits and carry with it potential for damage or loss of property, serious injury and death. That the participant assumes the risks of participating in these types of events and activities, that they are fit, and they have a regular medical physician they can contact regarding any medical problems that they might develop.
  5. Acknowledges that it is recommended to consult a physician prior to starting any health/fitness/nutrition program.
  6. The participant expressly waive, release, discharge and agree not to sue from any liability of death, disability, personal injury, or action of any kind Desert Tree Fitness, LLC. DBA Maricopa Adventure Boot Camp and its instructors, officers, affiliates, and executors for the participant participating in said sporting events and/or training for said sporting events.
  7. Boot Camp client shall not, after completing boot camp, engage directly or indirectly, either personally or as an employee, associate partner, partner, manager, agent or otherwise, or by means of any corporate or other device, in the Indoor/ Outdoor fitness or Boot Camp fitness business within 50 miles of Desert Tree Fitness, LLC. DBA Maricopa Adventure Boot Camp.
  8. I understand there may be no refund policy after the class has started and I have selected the class package that best suits my schedule so that I can take full advantage of all the classes I signed up for. Further, I understand that there is a $50.00 Cancellation Fee if I do not cancel my registration online prior to when class starts.
  9. I understand that there are no make-up days and I have chosen the class package that best suits my schedule.
  10. If an emergency arises, I will notify my trainer immediately.
  11. I understand the possible risks associated with my participation in the activities offered by Desert Tree Fitness, LLC. DBA Maricopa Adventure Boot Camp
  12. I consent to taking all of the above noted risks by VOLUNTARILY PARTICIPATING in the activities of Desert Tree Fitness, LLC. DBA Maricopa Adventure Boot Camp
  13. I agree to show up for Boot Camp every day unless it is an excused absence from my doctor or pre-approved with Boot Camp directors.
  14. I understand that photos or video may be taken during the course of my involvement in Boot Camp, which may be used for promotional or any other purposes and I release any liability that may arise from using my likeness. I also waive any copyright or moral rights associated with my likeness. I understand that my "before & after" photos will not be used for any promotional purposes unless I give written authorization.
  15. Camp fees can not be used towards any other products or services provided by Desert Tree Fitness, LLC. DBA Maricopa Adventure Boot Camp
  16. I understand that diet and nutrition will effect my fitness goals and performance during boot camp.
  17. I understand that Bootcamps are not intended for external personal trainers and their clients.
  18. I understand that Desert Tree Fitness, LLC. DBA Maricopa Adventure Boot Camp has the right to refuse service to anyone for any reason.
  19. I understand that Desert Tree Fitness, LLC. DBA Maricopa Adventure Boot Camp will not tolerate abuse of any kind.

The participant agrees that this is the full agreement between the parties, that neither representatives of Desert Tree Fitness, LLC. DBA Maricopa Adventure Boot Camp nor anyone else has verbally contradicted any of the terms of this release and that the participant has entered into this agreement free and voluntarily without force or coercion.
